Terms of Service – SNX Scales

Welcome to SNX Scales! By using our website (snxscales.com) and services, you agree to these Terms of Service. Please read them carefully.
1. Services Provided
SNX Scales creates and sells websites and provides ongoing website management under a monthly plan. Hosting is provided via Webflow. SNX Scales is not responsible for outages, downtime, or technical issues caused by Webflow or other third-party platforms.
2. Account Eligibility and Responsibilities
• Clients must be at least 13 years old to use our services.
• SNX Scales maintains access to and manages the website as long as the client is subscribed to the monthly plan.
• Clients are responsible for notifying SNX Scales of any issues with the website.
• If the client does not renew the monthly plan, SNX Scales will no longer manage the site, and access will be transferred upon request.
3. Billing and Payment
• Plans are billed every 30 days. Payment is accepted via e-transfer or PayPal.
• Payment is requested manually by SNX Scales.
• If payment is not received within one week of the due date or after site upload, SNX Scales may suspend the website until payment is made.
• Clients must notify SNX Scales at least 7 days before the next billing cycle to cancel the monthly plan.
• No refunds are issued once the 30-day period begins, including if a client cancels mid-cycle.
4. Ownership and Intellectual Property
• SNX Scales retains all rights to the websites, designs, and content while actively managing the site under the monthly plan.
• Upon cancellation or non-renewal of the monthly plan, the client may create their own Webflow account, and SNX Scales will transfer the website and domain to the client.
• All images, text, and other content provided by the client remain the property of the client.
• SNX Scales reserves the right to showcase the website in its portfolio.
• Until transfer, clients may not claim ownership of the site or its content.
5. Acceptable Use
Clients may not use the websites for:
• Illegal activities, harassment, or fraud.
• Infringing on copyrights, trademarks, or other intellectual property.
• Distributing spam, malware, or harmful content.SNX Scales reserves the right to suspend or terminate service if these rules are violated or if the client fails to pay for services.
6. Limitation of Liability
• Websites are provided “as-is,” and SNX Scales is not responsible for issues caused by third-party platforms, including Webflow outages or downtime.
• SNX Scales is only responsible for the services directly provided, such as website design, setup, and ongoing management under the monthly plan.
• SNX Scales is not liable for loss of data, revenue, or profits resulting from website downtime, technical issues, or third-party failures.
7. Indemnification
Clients agree to indemnify, defend, and hold harmless SNX Scales from any claims, losses, damages, or legal actions arising from the client’s use of the website, content, or violation of these Terms.
8. Force Majeure
SNX Scales is not responsible for delays or failures caused by events outside its control, including natural disasters, internet outages, or third-party platform issues.
9. Dispute Resolution and Governing Law
• These Terms are governed by the laws of British Columbia, Canada.
• Any disputes will first be attempted to resolve informally through communication between SNX Scales and the client.
• If unresolved, disputes may be brought in the courts of British Columbia.
10. Electronic Communications & Notices:
• Notices of payments due can be sent via email or text and are considered received immediately.
11. Severability Clause:
• If one part of the Terms is invalid, the rest still applies
12. Modifications
• SNX Scales may update or modify these Terms at any time.
• Updated Terms will be posted on the website with an updated effective date.
• Continued use of SNX Scales’ services after updates constitutes acceptance of the new Terms.
13. Privacy Use of the SNX Scales website is also subject to our Privacy Policy. By using the website, clients agree to the terms outlined in the Privacy Policy located in the footer of the home page.
